New $100 Asylum Fees: What You Need to Know

With so many TikTok videos and social media posts spreading misinformation about asylum fees, we want to make sure our community has the facts directly from official sources: USCIS, the Federal Register, and the EOIR Payment Portal. Some people believe that everyone has to pay right now — that is not true.
Under the One Big Beautiful Bill Act (OBBBA), USCIS has created two new fees for certain asylum applicants.

Asylum Fees Overview

The EOIR Payment Portal
The EOIR Payment Portal is now fully updated to reflect both the Initial Asylum Fee and the Annual Asylum Fee (AAF) options for cases pending before Immigration Court. As shown in the attached screenshot, the dropdown menu now includes:
“Court – I-589, Application for Asylum (Initial Fee)”, and
“Annual Asylum Fee (AAF) – Pending Application for Asylum.”
This confirms that EOIR has implemented the online payment option for both fees.
What This Means for You
If your asylum case is pending before USCIS, you should continue to wait for a personal notice that will instruct you when and how to pay the annual fee.
If your case is pending before Immigration Court, we expect the government to issue similar notices based on prior announcements. However, we have not yet seen any such notices for our defensive asylum clients. We hope to receive either official confirmation that these notices will also be sent to individuals with cases before the Immigration Court, or an actual notice for one of our clients before confirming that process.
At this time, if you attempt to make a payment on the EOIR Payment Portal but do not have an active court date scheduled, you will likely see the following error message:
“An error occurred while processing your request: Invalid alien number. Please try again. If problem persists, please contact ECAS Tech Support using the contact information at the bottom of the page.”
This means your case is not yet active in the court system for payment processing.
Regardless, the EOIR Payment Portal now provides a way to pay the $100 annual asylum fee once it becomes due. You will need your A-Number to make the payment. You may also choose to pay the annual fee early, even before receiving an official notice, if you prefer.
Important: After completing your payment, save a copy of your digital receipt and send it to your attorney. This documentation will be necessary to confirm that the payment was properly recorded in your case.
